How can Parking issues be enforced
I would like to know how to enforce parking issues.

Currently, the parking bays was "bought" with the property, but according the building plans and rules at the deeds office, the parking areas is part of common property!

The trustees of 2003, did try to do something, but trustees afterwards decided to discontinue any work done, refuse to comply to only 2 or 3 owners to address the issue.

Your help would be appreciated.

Hi N403

Parking on the common property would be enforced by the registered conduct rules of the complex.

If parking is allocated to owners in the sectional plans or the common property it can be enforced.

If parking allocation is not shown on the sectional plans or the conduct rules it cannot be enforced.

Hi: there is a way: Sect 27(a) of the act allows you to allocate exclusive use areas quite simply, by changing your management rules and registering same at the deeds office. You will need a lawyer to register same, but you don't need a land surveyor.
Get a copy of your sectional plan and by hand color in and number the various parking bays shown on it. On a seperate piece of paper, or better still somewhere in the margin, show which parking bay no is allocated to which unit.
You will need a unanimous resolution to change your rules, so do your homework carefully and address all the issues currently in your scheme that the owners think need attention, otherwise you will be changing them once a year if you are not careful!
The parking bays will remain common property but give each owner exclusive use to his parking bay, thereby settling any disputes that may arise. Don't however touch any visitor parking bays cause building regulations require a minimum of these. Get a zoning certificate for your erf no and check this out.
