Who needs to authorise alterations I live in a Sectional Title with 40 units
1. If I need to makes alterations (build a room on top of the double garage), who needs to authorise it? Only the trustees or the body corporate also? Do I need the neighbours consent also since for instance the alteration will obstruct maybe their view etc? 2. Is there a limit in square meters or percentage that an entire Sectional Title Complex can be altered (extended)? 2. Extending sections deals with the extension of sections. This would include building another room on top of the garage. 1. The body corporate must authorise the extension by way of a special resolution. 2. There is no limit, however, there are further requirements for extensions which alter any unit's participation quota by more than 5%. 3. The same as 2. Regards Grant |

Re: Who needs to authorise alterations Hi Ramphart: you're treading on dangerous ground here. Read Section 24 of the act and you will find horrific requirements for your proposed building. In the end I reckon your costs here would be so great that it does'nt warrant the extension. Rather sell up and move to a bigger home!
Further to sect 24 you will need an architect to submit building plans to your local council. A zoning certificate on your erf no will tell you what's allowed and not, particularly in respect of something called Floor Space Ratio. Architect can work this out quite easily. Sounds as though your garage is either freestanding or attached to your building: in either event the top of the roof of your garage does not belong to you but in equal proportions to evey owner in the complex, irrespective of whether your garage is part of your section, or Exclusive Use Area allocated to your unit. If not part of your unit or EUA, you must first go thru the requirements of section 27(a) I know it's bad news, but check these things out even before you ask anyone's permission Regards Jurgens |
